Response to Public Comment

Is there an opt-out policy for students, teachers, etc.? Could a substitute opt-out?

Response: The California Education Code (sections 51937 and 51938) specifically states that parents have a right to “to excuse their child from all or part of comprehensive sexual health education, HIV/AIDS prevention education, and assessments related to that education…”  Classroom teachers can provide special instructions to substitutes that inform them that they will be teaching sexual health education or HIV/AIDS prevention lessons.  The substitute has the option of not taking the job.
