Update on Negotiations with SCTA/SEIU

Dear SCUSD Families: 

You may have already learned that the Sacramento City Teachers Association (SCTA) and SEIU Local 1021 announced a planned strike to begin on Wednesday, March 23, 2022. We will keep you informed as we attempt to reach an agreement with our labor partners to avert a strike.

As we wrote previously, we want to do everything possible to continue serving our students during the strike. However, our district operates under limitations that make it difficult for us to keep our schools open during a strike. Specifically, because substitute teachers in SCUSD are represented by SCTA we are significantly limited in our ability to hire substitute teachers to fill in for those who strike.

Given these circumstances, we have made the difficult decision to close all campuses if a strike takes place beginning on Wednesday, March 23, 2022.

We understand that many in our community will ask whether they can volunteer to keep schools open. Unfortunately, fingerprinting is required for volunteers and the short window of time is not enough to approve volunteer clearances.

Since last summer, the district has been working to reach agreements with labor partners that address issues related to COVID for this 2021-22 school year only. Because our district had not reached an agreement with SCTA on these COVID-related issues, the district declared impasse in these negotiations in December 2021. Neutral mediators were called in to facilitate talks, but after several sessions the mediators recommended that both parties participate in a Fact Finding process, which is the next step under California law. The Fact Finding report is advisory, and is intended to help parties resolve differences so a formal agreement can be reached. Despite concerns about how some of the recommendations could impact our long term fiscal stability, we are committed to finding solutions that meet the needs of our students and staff.

We remain committed to do all that we can to avert a strike and expect to continue successor contract negotiations on Monday in an attempt to reach an agreement with SCTA.

This is a painful and difficult decision to make, especially when our students have experienced so much trauma and disruption to their learning over the last two years and recognize the ripple effect that school closures have on our entire community.

Es posible que ya se haya enterado de que la Asociación de Maestros de la Ciudad de Sacramento (SCTA) y el Local 1021 de SEIU anunciaron una huelga planificada para comenzar el miércoles 23 de marzo de 2022. Lo mantendremos informado mientras intentamos llegar a un acuerdo con nuestros socios laborales para evitar una huelga.

Como escribimos anteriormente, queremos hacer todo lo posible para continuar sirviendo a nuestros estudiantes durante la huelga. Sin embargo, nuestro distrito opera bajo limitaciones que nos dificultan mantener abiertas nuestras escuelas durante una huelga. Específicamente, debido a que los maestros suplentes en SCUSD están representados por SCTA, nuestra capacidad de contratar maestros suplentes para reemplazar a los que están en huelga es significativamente limitada.

Dadas estas circunstancias, hemos tomado la difícil decisión de cerrar todos los campus si se produce una huelga a partir del miércoles 23 de marzo de 2022.

Entendemos que muchos en nuestra comunidad preguntarán si pueden ser voluntarios para mantener abiertas las escuelas. Desafortunadamente, se requiere la toma de huellas dactilares para los voluntarios y el corto período de tiempo no es suficiente para aprobar las autorizaciones de los voluntarios.

Desde el verano pasado, el distrito ha estado trabajando para llegar a acuerdos con socios laborales que aborden problemas relacionados con COVID solo para este año escolar 2021-22. Debido a que nuestro distrito no había llegado a un acuerdo con SCTA sobre estos temas relacionados con COVID, el distrito declaró un punto muerto en estas negociaciones en diciembre de 2021. Se llamó a mediadores neutrales para facilitar las conversaciones, pero después de varias sesiones, los mediadores recomendaron que ambas partes participaran en un Proceso de determinación de hechos, que es el siguiente paso según la ley de California. El 17 de marzo se emitió un informe del presidente del panel de tres personas que dirigió el proceso de determinación de hechos y se puede leer en su totalidad aquí.

El informe de determinación de hechos es de carácter consultivo y está destinado a ayudar a las partes a resolver las diferencias para que se pueda llegar a un acuerdo formal. A pesar de las preocupaciones sobre cómo algunas de las recomendaciones podrían afectar nuestra estabilidad fiscal a largo plazo, estamos comprometidos a encontrar soluciones que satisfagan las necesidades de nuestros estudiantes y personal.

Seguimos comprometidos a hacer todo lo posible para evitar una huelga y esperamos continuar las negociaciones del contrato sucesor el lunes en un intento de llegar a un acuerdo con SCTA.

Esta es una decisión dolorosa y difícil de tomar, especialmente cuando nuestros estudiantes han experimentado tanto trauma e interrupción en su aprendizaje durante los últimos dos años y reconocen el efecto dominó que tiene el cierre de escuelas en toda nuestra comunidad.

Durante este momento difícil, permanezca en la comunidad y sepa que haremos todo lo posible para satisfacer las necesidades de la comunidad de nuestro distrito.
